TRADEJA
These Terms of Service ("Terms") govern your access to and use of TRADEJA ("TRADEJA," "we," "us," or "our"), a zero-cash, peer-to-peer trade marketplace operated by TRADEJA LLC, currently serving the Denver, Colorado metropolitan area. By creating an account, listing an item, or otherwise using TRADEJA, you agree to be bound by these Terms. If you do not agree, do not use TRADEJA.
TRADEJA is a platform that connects individuals who wish to trade personal items directly with one another. No cash, payment processing, or monetary exchange occurs on or through the platform. TRADEJA does not buy, sell, own, inspect, appraise, or take possession of any item listed by users.
TRADEJA acts solely as a neutral facilitator that provides tools for listing items, discovering potential trades, and communicating with other users. TRADEJA is not a party to any trade agreement formed between users.
You must be at least 18 years old and capable of forming a binding contract to use TRADEJA. By using the platform, you represent that you meet these requirements and that all information you provide is accurate and current.
You are responsible for maintaining the accuracy of your account information and for all activity that occurs under your account. You agree to provide a valid email address and general location (zip code) for the purpose of enabling local trade matching.
TRADEJA reserves the right to suspend or terminate any account, at its discretion, for conduct that violates these Terms, is fraudulent, or is harmful to other users or the platform.
Users are solely responsible for the accuracy of their own listings, including item descriptions, condition, and photographs. All trades occur on an "as described" basis between the users involved.
TRADEJA does not verify, warrant, or guarantee the condition, authenticity, safety, legality, or value of any item listed on the platform. You assume all risk associated with evaluating and trading items with other users.
Prohibited items include, without limitation: stolen goods, weapons, illegal substances, hazardous materials, counterfeit goods, live animals, and any item that violates applicable federal, Colorado, or local law. TRADEJA may remove any listing at its discretion.
All trades are agreements made directly between users. TRADEJA does not mediate, guarantee, insure, or reverse any trade. In the event of a disagreement between users regarding a trade, TRADEJA may, at its sole discretion, act as a neutral facilitator to help surface information, but is under no obligation to resolve the dispute and is not liable for the outcome.
You agree to communicate honestly and in good faith with other users, to meet in safe public locations when exchanging items in person, and to exercise reasonable judgment before completing any trade.
TRADEJA does not process payments, hold funds, or facilitate any monetary transaction. Any exchange of cash or other consideration outside the trade of physical items is outside the scope of TRADEJA's platform and occurs entirely at users' own risk and outside these Terms.
You agree not to:
To the fullest extent permitted by law, TRADEJA LLC and its founders, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of property, arising from your use of the platform or any trade conducted between users. TRADEJA's total liability for any claim arising from your use of the platform shall not exceed fifty dollars ($50).
TRADEJA is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied.
Bartering may have tax implications under federal, state, and local law, including the requirement to report the fair market value of goods or services received in a trade as income. TRADEJA does not provide tax advice, and users are solely responsible for determining and reporting any tax obligations that may arise from trades conducted through the platform.
You agree to indemnify and hold harmless TRADEJA LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your listings, your trades with other users, or your violation of these Terms.
TRADEJA may modify, suspend, or discontinue any part of the platform at any time. We may update these Terms from time to time; continued use of TRADEJA after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Colorado.
Questions about these Terms can be directed to TRADEJA LLC at the contact information listed on tradeja.co.
